My son was charged with statuory rape. I don't know all the details but I do know that she went to his house and remained even when told to leave and even though she was aware that he was intoxicated and not able to make decisions.
I know that it doesn't matter. I know that that even though she pursue it, initiated or whatever that he is guilty regardless.
Please, make me understand why some people get a lesser sentecence or even get away with it. Like the Broadway actor. He received probabation.
Like the teacher that had a long relationship with more that one boy: she received lesser sentence. I know it varies from state to state.

Why not look at the individual and his past situation? Why not recognize the fact that given a different circumstances, it would have never happened.

The court will do that; his individual circumstances will be considered.

...make sure you get legal counsel to handle this for you and with you. This is not an area of law to manage alone.

Thanks for the answer.

I feel for him because he is NOTa sexual offender nor did he ever tried to approach anyone for that reason.
His life has been all about his family. He lived for them. Nothing else mattered.
He has three small young children and his wife left him for someone else a couple of months before that happened.

He went south to work to save enough money to have the children back with him.
He is a good kid and would never hurt anyone.
I sent a letter to the judge and the DA and his attorney (court appointed attorney) hoping to make them see that he needs help, not prison.
We have criminals walking the street every day, I said: why pick on somone that needs help? He didn't ask for that. He didn't want to be with the young lady. He was in his own house, minding his own business so why is Justice so cruel?

Sorry. I guess I got carried away!!!!
