Question Problem in Canada

Hi all,
I'm an Ontario citizen and recently I had a problem with my bank where they withdrew several thousand dollars without my authorization and without even warning me before or after they withdrew the money. I came to discover after assessing the situation that they took the money because one of their clients, we'll call him John, worked for the same company as I did, we'll call it company. John went to the bank and said that he wasn't getting his full pay. After the bank assessed his account they discovered his money was going to me so they withdrew all the money that the company that I worked for paid me. After a while of investigation it was realized that not only had his money been coming to me, but mine was going to him. Now they're giving me back my money. There is a problem, however, with the fact that apparently I was overpaid originally and now I'm going into over draft because I basically spent whatever money was on my account. I didn't know about the overpayment. I spent the money based on waht I knew I had in my account. Does it make a difference that I no longer work for this company? Does the fact that the bank took my money out without warning or notification give me a case? Any advice would be useful?

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior--they have no right to do that.

Thank you for the response. I actually just found out that they also gave the other client my name. Isn't that information that is not supposed to be disclosed? Anyways do you know any website or what not that gives legal advice on this. I'm a student so, naturally, I'm looking for something that can be paid for on student wages. Finally if you guys are willing to give a recommendation; is there a risk in just threatening to file a suit for now?
