Default Did not receive a summon to court

I just received a call from a supposed lawyer, and he said that I was supposed to be in court an hour ago. It is for a credit card that I owe on from 2004. He said that he will give me 72 hours to pay the full amount of $1200 or I will have a warrant out for my arrest. I never received a certified letter or been served to go to court. I told him this and he just said that they sent a letter to my old address; I have not lived there in two years. Can there really be a warrant for my arrest be issued? Please Help.

No he cannot issue a warrant or even threaten it, and it is illegal to say so.

And you have to be served court papers properly.

If he is not a lawyer it is a crime to say that he is.

This was an obvious, and typical ploy of a collection agency.

He violated the Fair Debt Collection Practices Act by claiming he was an attorney when in fact he was not. No legitimate attorney would call you directly and say the things this person said to you.

Threatening you was another violation of the FDCPA. Call a consumer protection attorney in your area. Many work on a contingency basis. You may be able to collect money from the collection agency for their flagrant violations.

This was a classic ploy by these bottom feeder collection agencies to get you to pay for a debt that has not been proven to be yours. Never acknowledge a debt to be yours to a collection agency. In fact, do not deal with them at all.
