ALBANY - A federal judge has ordered the stalled Bigger Better Bottle Law to be implemented and said deposits on water bottles should be coming in October.

U.S. District Judge Deborah Batts modified an injunction won by the bottled water industry delaying the expanded bottle deposit law until April 2010. She ordered most of its provisions to be effective immediately, notably more of the unclaimed deposit money going to the state and higher handling fees for recycling centers.

She also strongly suggested water distributors quicken preparations for the nickel deposit and redemption of empties. At an Oct. 22 hearing, they must show why compliance isn't possible. "It is the court's expectation that [water distributors] . . . are actively working to achieve compliance with all aspects of the bottle bill," she wrote.

A similar bill in Connecticut goes into effect Oct. 1, and one water bottler, Nestle, told the court it could "fully comply" with the New York law by then.
