I have an idea to improve upon an exisiting product. I'm positive the existing product is not patentable. The technology that improves the product is already in existence. But the two have never been combined. Is there legal protection for my idea?
For example: Let's say that in the early 1900's, someone wanted to use a combustible engine to power a sawmill. The sawmill had been used for decades, but was always powered by water. The combustible engine had been invented, but was only used for transportation. Could this new concept be pantented? |

If the combination is unique and creates a new product or system it can be patented in some cases--yes.
It is best to have a patent lawyer at least briefly review it with you if critical, as the law does get detailed and complicated on that area. |
