Default Potential Issues with Democratic Play?

Hello.

I'm an engineer at a music radio station. I know nothing of the laws or regulations regarding radio stations, my job is to simply come up with ideas. I have what I think could be a great idea, but I can see it being legally questionable.

My idea is this: have a period of time devoted to what's called "Democratic Play." This feature allows users to vote on what songs they want to hear. Votes are cast via a website. The songs are then played based on the number of votes.

The problem I immediately see with this idea is to assume there's only one popular song. As I described it, if the users continually vote for the same song, the same song will be played over and over again. I don't think this would make the RIAA very happy, so I could easily implement a cooldown system. Would that work?

I don't see how this is a whole lot different from people calling in and requesting songs, so I feel like I could make it work. I would love some advice here!

I wish to inform you that if you inform your customers that songs are being played on voting then any song which gets maximum vote will be played. If that song again gets maximum votes then it may again and be again played. In this if you do not intend to repeat songs then you may add a condition to voting that same song may not again be the winner that day or similar other rule. In this if you yourself implement cooldown system and affecting the working what has been promised and what actually has been delivered to people then your radio may be liable for misleading public. Therefore if your acts are with proper disclosures to customers then you can perform the acts. .

AFFA, thank you for that information. It shouldn't be a problem as I was planning on providing an agreement on the web page. You don't believe the RIAA will take issue with this?
