Adidas and their lawyers are going mad and scaring all kinds of innocent victims of fraud. I have done some online research and there is none that admits he/she was sued for trying to resell a supposedely counterfeit adidas item. The resale is made innocently and unknowingly. I have a friend who got this 'cease and desist' letter for just using a picture of a jersey that has adidas logo. Are people scared to admit they are sued? is there any guideline anywhere to suggest a legal way to stop this adidas madnes and harrassment for first time unknowing violators who made an honest mistake? It is rathe a huge cost of $450 and surrender of the jersey by the victim who purchased it online anyway. These lawyers go after the small people and not after the big manufacturers and distributors especially for goods coming from China. Does Adidas actually spend money to sue for $450? I dont think they have a chance to win with a understanding judge presiding.
questions: 1) If the first time violator receives a request to cease and desist, and he actually agrees to cease and disist, why does it become the basis for a lawsuit? why must he/she pay the $450? the violation was one time, unintentional and not for manufacturing and distribution? 2) cant somebody open a website and pretends to be a law office and does some 'phishing' and collects money? shouldnt the letter be handed by a court? |

Adidas corporation goes after the "small guy" and not the large companies for ONE reason! The average Joe is typically trying to just make an extra buck! He has a full time job, and sells some products on ebay for a little extra cash. The big sellers do this full time! It is their bread and butter. They are legitimate companies who are registered with the U.S. Government! Now, adidas would think to "sue" one of these companies for the same reasons that they are sending these letters to average joes! Why? Because if adidas did do so against a company selling these products with a license, they would have a counter suit filed against them so fast they wouldn't know what hit them! These companies are very professional. They have corporate lawyers who know the laws inside and out! They would tear Adidas to pieces, and Adidas knows that. So, what do they do? Pick on the little guy. The little guy "doesn't know any better." That is the God's honest truth. Any average Joe doesn't understand corporate laws. He gets a letter that makes it sound like he's done something terrible and is in huge trouble, so of course he will fork over $450 bucks to try to keep himself out of trouble!
Really, these letters are sickening and morally wrong! They are hurting the people who don't have the extra cash and are struggling; only for their own greedy advancement desires. Don't buy into their threats! It is nothing but a BS way of trying to get you to give them money. Don't you LOVE the corporate world???? |
