Hello,
I am a registered small business owner who has trademarked my business name (including similar words) in two classes locally in Australia. However, a much bigger digital computer company is using my name internationally. In the last two weeks they have just filed an trademark application for my name in the USA to use internationally. Does my local registered trademark protect my intellectual property rights ? Do I have a chance to protect this trademark (as it has only been recently filed in the last three weeks) ? I hope you can help ! |

You would be covered in the markets and to the extent you do business currently.
Future use would have to be decided between what you filed and what those US persons filed. The same e.g. happened with Budweiser beer in the USA and the Czech Republic--both had registered trademarks locally in their respective markets. |
