Cease and desist letter from adidas America, Inc.

What happened to your case? I have exactly the same situation going on and I certainly don't want to send them any money. I had no idea they were fakes.

They don't usually sue. They did not sue me. They certainly threatened it a bunch of times. But I honestly just got the stuff at a garage sale.

I was hoping you could help me. I received the same letter from Adidas for selling counterfeit football jerseys. I bought some from a guy in China and I thought he was selling them cheap because they were made there. They looked really nice and when I compared them to jerseys in the store, they looked the same. At any rate, Adidas wants me to send them $450.00 and give them all the jerseys in my possession if I have anymore. I'll be honest, if I would be assured that it would end there, I would do it. However, I'm not sure what to do? Please give me any info....I'd really appreciate it.

They usually will not really sue over that--your damage to them was not that great and it would be costly. But do cease all sales.

World Law's lawyers could also probably intervene and help resolve this if need be. You may email them on the home page.

so, what would your advice be in this case? if I do comply, would that mean that this trouble would be over?

i posted a rolex watch for sale on ebay,which i picked up overseas on a trip, i though it was fairly cheap back then , my item was ended right away when i listed it. i did mention that i was not sure if it was replica or authentic in the listing. A week later i recieved an email from Gibney Anthony & Flaherty at law It basically demend that :

1. Surrender all illegal merchandise I posses

2. Provide the identity of source of the illegal merchandise

3. Make payment to "Rolex Watch USA.. Inc
I do not know what to do if any one had this problem please le me know what was the outcome
I nticed the threads about the addidas but no one said any thing about what happened later on

1) Is there any legal forum or database where you can see the number of cases that the company did actually sue small businesses or individuals?

2) is there any group out there that can put a stop to these letters and defend the one-time violators? It appears that these company lawyers are out there to 'rob' individuals with their scaring tactics and abuse of the laws.

3) It also appears that if you abide by their demands, it will not stop the case but might strengthen their case. So, you will continue to need a lawyer to even meet their demands

4) where is justice?

I received the same letter today after selling 3 jerseys. I actually called the attorneys and got nowhere. When asked the question "How was I to know?" I was basically told too bad. I'm not really sure what to do either. My initial thought was just to pay the $450. However, after coming across this I am having second thoughts about that. As a collector of jerseys, I really don't mind keeping some for myself but I certainly did not make $450 on the 3 that I sold.

Man, I was scared untill I found this site. I did a bunch of research and no one ever finishes the story. Did anyone keep selling these or did anyone go to court over it? HELP Please.
