A funny thing happened today. I received an email today from ebay saying that 4 of my auctions had been removed because of An Adidas complaint. But these auctions ended in May and i have not sold on there since. Then I receved my second letter from adodas vanessa brackens with the usual threat. I thought it was over but for some reason ebay told me that auctions can be seen for 90 days after completion and so it looks like i am still selling. Also is ebay allowed to give out our personal information? Has it ever gone past this second request. Please ease my mind as i am new to this and I do not like being bullied like this

Re: Cease and desist letter from adidas America, Inc.
Has anyone been harrassed by this law firm of late? My son and I have now received our second email and supposedly a second letter is coming in the mail, first class not certified, and all over 1 jersey we had listed on EBAY. After I found this site, I've ignored the first letter and feel inclined to ignore this second one too but would like to hear from anyone who has some input.
Thanks. |

I too wish someone would be kind enough to send a follow up. I was dropshipping for someone. Never actually saw a jersey or shipped one out myself. I was just listing them.
I got an email but no letter a month ago and now I got a new email saying a letter was sent too(first class) Has anyone actually been sued for this? |

It seems like everyone posts something here once they receive a letter or email. However, there is never a reply about what happens next. That can only mean that nothing else happens and people forget about the letters. When someone goes to court, it is a scheduled date. If that happened to anyone from this firm, it would have been blogged about. The letters are not certified and everyone has the same story. Do not worry - they are not going to spend money, time, and resources - this is simply a scare tactic.

They never sued me; they just went away. But it took a while. They harassed me for a month or so.

I have been trying to figure out this same exact problem:
I have received 2 emails and both with letters in the mail the second one showed up TODAY (July 27, 2009) I have ignored them from day one. I refuse to respond because I feel that they have no proof what so ever that my REAL jerseys are fake, counterfeits or what ever they are claiming to accuse me for. I don't plan on sending them any money and I will be on here as soon as I find out the result of my problem. Please if anyone has the results to their problem inform us. thank you |

Okay so here goes!
These attorneys are scamish. They represent a lot of different companies, Tiffany's, Rolex, Adais several more. Everyone gets the same letter. The letter is intended to scare you! Really they want the money, but if nothing else they want you to stop selling their products. My sister had a Tiffany's necklace she listed on ebay. This necklace was the real deal, purchased from the Tiffany store. She had the receipt even! She listed this item on ebay and the listing was pullled due to vero. She wrote ebay swore it was real and then relisted it (without their permission...her mistake because her account was suspended). Again the listing was pulled and she got one of these letters. Her letter demanded $450 and the necklace. It's odd to me they demand different amounts. My sister freaked out and took the letter to our dad, who happens to be an attorney. He said it's a scare tactic. Ignore it. Let them come after you and if that happened she had proof it was real..so jokes on them! Also and this is important he said look at the letter by signing it and returning it you are CONFESSING to selling counterfeit goods. DO NOT do this. Once you do this who knows what will happen and what radar you are now on. He further went on to say most likely what is happening is they have deals with the companies they are sending the letters for that allows them to send the letters to stop counterfeiting and in turn they keep the money collected as their fee. This is why I said scamish. So my sister did nothing, nothing at all. Did not reply to anything email or letter. Several more letters were sent to her house and she had all email spammed so who knows how many emails she got. All the letters said the same thing "we demand you blah blah blah" After 3 letters they stopped. They realized she would not pay. If you're in this situation do nothing. However, I read some of you used photos from the net. This is illegal. You have to use your own photos. It's actually way easier to prove you used their photo than that you were selling knock offs. So NEVER use their photo. But even if you used their picture, the letter doesn't say squat about that so still do nothing. It's been a year and she hasn't heard a peep and dad says she won't. I think the reason no one posts a resolution on here is because there isn't one. It just slowly fades away. They never send you anything saying "we give up" so I suppose you never really know if it's over. She could get another letter tomorrow. Doubtful but possible. Also another point dad made was that for it to be legit there has to be a case number and it has to be sent certified mail so until that day comes relax! I also read on here someone said if you didn't pay it they could send you to collections. To do that they have to have your social security number, which I've never given ebay, amazon, ioffer, whatever website gave them your info to begin with. I hope this helps! Also, my 2-cents is this yeah it's a crappy thing for these companies to do. It's like they're hiring "thugs" to do their dirty work and they should be held accountable. These "lawyers" are scum and are just plain old bullies. Furthermore shame on ebay, amazon, ioffer, etc for giving these jerks personal information! They're allowing you to be beat up on, scared, and upset. I mean how else would they get your email addresses, real names, home addresses, etc. Thanks a lot Ebay! |

you people need to stop selling counterfeit merchandises and you will not get these letters. If you continue with your ways then we will take more drastic measures.
You have been forewarned. |
