Default Legal Signed Contract

What constitutes a legal contract now? Does it require your signature on it to make it binding and legal? Some of the companies in business now send a pamphlet with the first statement stating this is your contract. All it does is give you their rights and nothing about your rights. Why is it we cannot cancel poor service without paying a cancellation fee for it?

You have to agree one way or another, orally or in writing--or it is not binding.
