Default Consumer from Singapore needing some legal advice on a weird case.

Hi, I am from singapore and we are governed by the common law.

A brief summary of my case is listed below.

1. I signed up for a tour package at a tour agency.

2. I made payment and signed on a piece of receipt with terms and conditions stated behind it, the standard stuff that you find in a service provider company.

3. The company made a mistake and I paid lesser than I needed to for my trip which consists of a group of 10 people by an amount of $1560. Due to this admin lapse, the company did not realise their mistake until we came back from our trip.

4. Now the company is blaming us for not paying and expect us to pay up the full outstanding amt.

My qns is this.

1. In this case, r we binded to any contractual agreement that requires us to pay even thou we feel that its the company responsibility to bear the loss since its an admin lapse on their part.

2. If the matter is brought up to the police or the small claims court, k they force us to pay the full amt to the company? Like is it a no-win situation?

3. Are we actually considered guilty in the eyes of the law by refusing to pay even thou its the company who screw up the whole payment issue?

Technically yes you do need to repay if you agree it is an error; you can however argue hardship in having to pay all or any substantial portion--saying that it was their mistake after all, and you spent it w/o realizing it was in error, and paying back now would be difficult...they often will not sue or take any further court action in these cases but will try to work something out. They may even settle on a partial amount.
