I had made reservations for a friend to fly out of Bogota Colombia,to Los angeles,Ca,to take a cruise with me with Carnival cruises for 7 days. Her flight was with COPA airlines, reservations were made and Paid by me through the website TRAVELOCITY.
The day of the flight, the passenger went to the airport to take her flight and she was notified that her flight was cancelled, Copa agent claiming that Travelocity agent called on April 30th and cancelled it. At this point, she had no choice but to leave the airport,as there were no seats avail for her on that flight and the airline DID NOT offer to put her on another flight until the next day (and only by purchasing a new ticket), but that would have been too late to be on time for the cruise ,leaving the next day. I contacted Travelocity, and after listinning to the customer service conversations recordings, they have determined that I called on Apr 30th, ONLY TO get info re cancellation penalties, and the travelocity agent called Copa to find the answer to my question, however the Copa agent apperently misunderstood the American agent and went ahead and cancelled the reservation. At this point we missed making it to this trip due to the agents stupidity and negligence, and I'm out over $4000.00 of PAID monies , and worse of all I lost my friend's trust ,not believing that it was the airlines mistake. It has been an emotionally stressful matter to resolve....I'm still waiting for COPA airlines to admit that they were at fault, since travelocity has thier recordings and a cancelllation was NOT made by them, AND a totally ruined vacation that took over 2.5 months in planning and coordinating off from work on both parties. I NEED AN ATTORNETY TO FILE A LAW SUIT AGAINST COPA AIRLINES TO RECOVER MY MONIES SPENT FOR THIS TRIP PLUS ALL THE AGGREVATION THAT I SUFFERED DUE TO THIS MISTAKE,AND MOST OF ALL, A FRIENDSHIP THAT WAS LOST DUE TO THIS MISUNDERSTANDING ON THIER PART. Any advise, please?? |

I wish to inform you that as airlines has cancelled ticket without reason therefore you can claim reach of contract by other party and all the losses which directly accrue to you can be claimed. If flight ticket was booked through agent and agent knew about your cruise then you can demand compensation for cruise cost lost to you because you had informed your purpose to agent and information to agent is the information to principal.

Airlines are not required to compensate passengers whose flights are delayed or canceled. The only time compensation is required by law is when you are "bumped" from a flight that is oversold. Airlines almost always refuse to pay passengers for financial losses resulting from a delayed flight. These are called consequential damages and every airline exculpates themselves from these types of damages. If the purpose of your trip is to continue with other related travel, you might want to allow a little extra leeway and take an earlier flight. In other words, airline delays and cancellations aren't unusual, and defensive planning is a good idea when time is your most important consideration. As for the travel agent, once again, the agent could not predict the cancellation and therefore does not have foreseeability and subsequently liability. Anytime you travel from or to a foreign country, it is wise to purchase travel insurance. While I know that this is miserable, Travelocity will refund you your ticket price. If the reservation was cancelled, which it sound like this was what happened, then the rules of ticket issuance and cancellations by Travelocity will apply. It sounds as though a misunderstanding occurred and in all likelihood, Travelocity will refund the ticket price, however, they will not pay for consequential damages. |

Yes, the RESERVATION was mistakenly cancelled due to a language barrier and misunderstanding of the Copa agent. The flight was NOT cancelled.
Thanks for the advise. |
