Default Courier service mail theft

I recently contacted a courier service to deliver an envelope containing travellers cheques. The delivery guy obviously did not know what was in the envelope and it could just as well just have been documents of some sort. I asked him if the envelope was insured and he said yes. The parcel arrived emty at the destination and was stolen along the way by who ever. I contacted the courier service to claim back the value of the cheques and the person told me that their parcels are insured except for those containing cash.This was printed in fine print on the back of the paper that I signed with the courier guy (but never read, because I went with the delivery man's assurance).
The lost cheques was meant as a deposit to repair a machine the same day as I had a large order for items to be delivered. This contract was also cancelled because I could not get the job done before the deadline due to the broken machine, so a large profit was also lost.


Any opinions on the matter and whether I could press legal charges against the courier service?

I wish to inform you that travelers checks are not cash. If they are lost or stolen, you can make a report to the bank and request for a duplicate to be issued. Further, you can make a written complaint to the courier service for negligence. If they do not resolve the matter, you may file a lawsuit. You may claim damages and costs. You will have to prove the fact of loss of travelers checks by the courier service in the court. You may also show that travelers checks are not cash to the court. The court will consider all the facts and decide the matter. Alternatively, you may report the matter to law enforcement agencies. They will investigate the complaint.

Most courier/delivery services limit their liability for loss or theft to a minimum amount, and they tell you so in any paperwork you sign. If the value of the contents exceeds that minimum amount, then they usually require you to declare the contents and charge you extra to insure them to the declared value. And they ALWAYS tell you not to put cash or similar items in the package for your own protection.

Since you failed to read the liability statement, it's your fault that you were not covered for your loss by the courier service. You can't fault the courier for not telling you what was clearly in writing on your contract.

You might want to check with the issuer of your traveler's cheques to see if they have the ability to trace them or if they may be able to process a claim for the theft. However, any claim they may be able to process will NOT include the consequential damages (the lost profit from the failure of the machine to arrive in time, due to not being paid, due to not receiving the traveler's cheques).

You did say that the guy didn't know there was traveler's checks in there so it's not his fault. Most people don't send money that way. There's really nothing you can do.

Hi,
Its really strange that the courier company delver boy employee cheat envelope not the courier company any cost you are the looser. Hope you have all acknowledgment document with you. In you case i can suggest you may first approach manager of that courier company and request them to give compensation of your check, normally every single courier services provider have insurance services of their customer belonging. Hope they will understand and re-issue your payment but cannot clam loss on business.

I agree with you, the company has a huge responsibility and security is the main reputation of the company. I think the delivery person did something...

The first thing you need to do is contact the company that issued the traveler's checks so they can cancel them.

Traveler's checks are not cash. They have identifying numbers so whoever uses them can be traced.

Your best recourse is with the company that issued the traveler's checks for their being lost or stolen is the reason for getting traveler's checks in the first place. They can be replaced while cash cannot.
