Default DAYCARE WON'T REFUND balance on account he no longer attends.

My son attended Alpha Bits Daycare in Manchester, NH for the summer of '06. he doesn't usually attend during the school year as he has been in an after-school program somewhere else, I just couldn't get him into their summer program because it was filled. So Alpha-Bits it was, convenient to my work location. Two weeks before summer ended and the school year was upon us, i had a credit for 320.00 still with the daycare, i went to the office and said that my son will still have a credit of 320.00 and could they please forward the remainding balance to me in the mail, the lady in the office stated that they don't do refunds and where he will no longer be there his account won't be open so there is no account to issue the check, they are more than willing to allow him to use that credit for school vacation weeks and if not then apply the credit to next summer. I informed her that my son does not need school year care by them as he is already enrolled elsewhere convenient for his school, and I don't ever plan to have either of my children attend that facility in the future and to please forward the balance to me. She refused, i asked to speak to someone else, she refused and now it is a year later and still no refund. i had to claim that money on taxes and it was not used, it's just sitting in their account. My adamant refusal to use the daycare in the future is because three weeks before the summer ended i was picking my son up and they were on the playground, you need to walk by the babies to get to the big kids and as i passed there was a group of babies sitting in a circle on the rubber chips(instead of pavement or wood chips) and one had a mouthful and not one of the girls noticed because they were huddled up in a circle gabbing. i let them know and all she said was "oh, i didn't even notice".... well duh! the very next week, i went up into the classroom to pick up my son and the teacher was sitting in a chair near the door while the kids were sprawled on the floor watching a movie and she was ASLEEP!! HEAD BOBBING ASLEEP! i cleared my throat to wake her but she didnt' hear me, and then another child yelled my son's name to let him know i was there and she jerked awake glaring in the child's direction until she noticed i was there and changed her tune quickly. i was infuriated and went to the office and reported what i came upon and all that was said by the same account lady was "we'll take care of that". How can i get my money back!

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
