Default Breach of Contract?

I have requested copies of official college transcripts from a private, for-profit, business college in West Virginia. In early June, I requested (several times) copies of these official transcripts be submitted to a local college so my financial aid package can be developed, and allow to attend classes in August. This request required a $5.00 fee, which was forwarded appropriately upon their request. The check was cashed (I have a copy of it) in early July. As of this date (August 6), neither myself or the college I plan to attend has received these transcripts. I have sent e-mails (3), personal letters (3), and talked to them via telephone (numerous times); no one is wanting to assist me in my request, or plain out does not want to talk to me. I have forwarded a complaint to the WV Higher Education Policy Commission to seek their help in this matter, but they have referred me back to WV Business College. If theses transcripts are not forwarded to my new college before August 14, 2007, I will be unable to begin classes on the 23rd of August. I feel that, at the least, WV Business College has entered into the realm of Breach-of-Contract (cashing my check - albeit for $5.00, and not providing me with a requested service), if not they have violated regulations established via the US Department of Education (the school participates in Federal Aid Programs). Would you be able to provide any advice regarding this situation? Thank you. I look forward to hearing from you.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
