Due to lack of work and medical problems I wasn't able to work for a while. Towards the end of the first month with no work I called my bank to let them know my situation, and asked to setup payment arrangements. I was told the matter would be discussed, and my call would be returned. I waited nearly a month and never heard anything, so I decided to wait a few more weeks for my statement to see if anything showed. Nothing changed so I called again. This time I also asked about the possibility of taking out another loan to consolidate the two, in addition to or in place of payment arrangements, so that I could use the one month grace period to get back on my feet. I was told the same thing again, the person I needed to speak to wasn't there, and they would have them call me back. I waited again, never to hear anything from the bank. After another month or so both vehicles were repossessed without notice. I talked with the guy that came, and explained the situation to him. He offered to call the bank on my behalf to try and come to a settlement. They wouldn't negotiate with him, so I called. To make a long story short, I was ridiculed more than once by nearly everyone I spoke to at the bank that day and the next, for not making an effort. When I explained that I had called multiple times to make arrangements, and that I was awaiting a response from them, I was told by a president of one of their branches that "It is not our responsibility to contact you about payment arrangements". Can they really do that? I was told more than once by the bank that the matter would be discussed, and I was told my calls would be returned. I was waiting on one w-2 so I could file my taxes, and pay the full amount past due. I explained that to the bank, they told me the amount due, including all fees associated with the repossessions, and told me I had less than a month to pay it to get my vehicles back, before they were auctioned off. The very next day I called to verify the amount so I could make the deposit, and I was then told I had to pay both accounts in full to get the vehicles back (nearly $14,000). This bank has done nothing but give me a runaround. Is there anything I can do, short of filing bankruptcy? The bank has already filed a claim in court over one vehicle, which is less than a month away. Any help or advise is greatly appreciated. I've already filed a complaint with the BBB to no avail. They sent two letters to the bank over the matter, and they never received a response either. Should I move up to the state attorney? Something else that might be of importance: The bank never notified me of the date, time, or place of auctions. I know in some states (I'm unsure about Oklahoma) that banks are required by law to give that information so the person has a chance to get the vehicles back. Any thoughts?

You unfortunately do have to be persistent and arrange any compromise if you are missing payments. Once you are late they have all the remedies that lenders have in those loan agreements--unless you can convince them to acept new terms.

I tried to make arrangements before my account even became delinquent, but they wouldn't speak with me. I was given a runaround over the phone. I explained my situation. I let them know I needed to make arrangements. I was told more than once (by Chea) she would talk the matter over with the person that dealt with those issues(just so happens to be Chea), and call me back. The person that I spoke to WAS the person that dealt with arrangements. I was given a runaround. Being persistent (or not) shouldn't have anything to do with it. Could it be argued that them not responding at all is a form of entrapment?

Not really unfortunately; but you can argue they made a new agreement with you and have not now kept it. That may be the best way to win here if you feel you can honestly say that.

When you open account with Bank of America make sure not to allow any negative balance transactions on your account. The bank drains your money even if my mistake also you have negative transaction, each transaction even for a penny may cost you $ 20 to $35. Make sure to ask them not to have transaction on the account if there is no balance
We paid 150$ for our own money which was in Saving account but not in checking. Is there any way to claim this money? We were not told this feature by concern person while opening account now they show small letters booklet which they hand over to each customer. The representative claim she also lost money due to this and has atleast one customer reporting this to the bank. Can any one help us to know if there is any way to claim this money from bank. |
