Confused Legal Options Concerning Virtual Property?

What are my legal options in the following situation?

I was a loyal member of the website Neopets.com (www.neopets.com) for nearly six full years. Needless to say, I spent a lot of time and some very real money on their site. However, my main account and side accounts (which are permissible according to their rules) were unjustly frozen without warning or a clear explanation why. I still to this day don't fully understand why my main account was taken away. I have repeatedly ask their customer service and received nothing but automated messages. I took this issue up with the BBB, the Ohio AG, and the California AG and in all cases Neopets Inc ignored my questions and refused to communicate with me. Even though this occured online, I am still a paying customer who did not break the ToS--therefore, they breeched their contract with me.

Other facets of this case include; the same customer service representative dealing with this case despite the fact I have bad blood with her (due to her mocking my religion), refusal to let me speak to another representative, their inability to explain why my account was frozen, the refusal to accept any evidence that proves my own innocence, them changing the contents of my emails to their support to deliberately deny me customer service, the inability to follow up on the support they did offer in their emails, hiding all their contact information from the general public to force them to go through an automated message system, freezing my account and not someone else's whom they admit they did the exact same offenses they claim I did, and a long and repeated history of treating many other users the same way.

What are my legal options in this situation to get my accounts (or at least my main account) back? Consider the recent Braggs v Linden case. More information is available upon request. It should also be noted that I am currently working abroad for one year in South Korea.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior, or maybe World Law's lawyers could help contact the firm etc.

Thank you for your reply! I have some follow-up questions.

I will be out of America for another six months--can I file in court despite being overseas? I'll probably have to be present at the trial--how can I work with the aforementioned problem and my situation? I'd rather not wait six months as there's a good chance they'll completely delete my accounts in that time.

Maybe this is a bit silly but...could I sue for virtual reimbursement instead of/as well as actual money?

It would be wonderful if a World Law lawyer could communicate with Neopets Inc on my behalf (although I suspect the company will continue to refuse to talk). I have most of my communication with this company documented as well.

I would suggest you email them on the site home page to discuss directly with them. I am sure they would help you.
