Shady Card Dealer
This is complicated and I'm not sure what to do. My husband who is disabled,64 years old,on ALOT of medication as well as a fixed income of $900 a month went to a car dealer looking at cars.he knew he couldn't afford one but he gets the urge to look every so often. My husband is a co-debtor on our mortgage of $566 a month as well as a truck payment of $402 per month. He knew this and told the dealer this, remember I am not there. The dealer somehow confused mt husband into signing 2,not 1 but 2 sales contracts for vehicles with payments of $400+. He told them his financial situation and said he couldn't be financed he just didn't make enough money but they insisted that they would hold his vehicle which we owed $11000 on and he could go home and make up his mond and come back the next day to decide which one of the vehicles he wanted because now he had to take one of them.he cam home completely confused and told me what happenned.I contacted the dealer and they inflated his income assuming I would be paying for it. I believe this is completely unethical if not illegal so we contacted the 3 main credit companies and placed a fraud alert on his credit to keep them from sliding this SALE through. On this day of THINKING the dealership paid off our vehicle, and placed it on their lot with a price in thw window. Now we are without this vehicle but it is paid for. What should we do? Is he obligated to pay for 1 or both of the vehicles since they turned in false information to obtain them? there's no way he can pay them and I refuse to.I wasn't even there and my name is on nothing but the dealer turned in MY income.Help,I need answers.

Return both and don't pay. Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.

we don't have any of their vehicles and never did,we don't even have the one he"traded".he's borrowing my truck while i'm working but I am worried we will be responsible for paying for the their vehicles. i can go get him another car but can the dealer make us pay for the ones he signed for? i don't think what they did sounds legal but i am no expert.

Woo Hoo!!!!!Great News.We visited a lawyer and verified the fact that They broke the law by turning in false information in order to get the deal through and after going back to the dealer, they rescended the previous contracts and we left with the vehicle he drove in with, owing the same amount. They made it right.we both signs forms not to hold each other liable for the sales and he left in the same position he was when he went in. Not everything is hopeless.our lawyer still wants to sue but we don't.all we wanted was to make things right and they did.we're done, and thankful to not be forced into the contracts.
