I cannot get my item

I purchased a painted golf cart body on 1-27-09. The stated it would take 2 or 3 weeks to complete.I payed $345 for the body and shipping on 1-28-09. 2-27-09 e-mailed saying it was about finished. 3-14-09 e-mailed he would ship it out week of 3-14-09. 3-25-09 emailed it would go out by 3-30-09 or issue refund.3-30-09 e-mailed that he had dropped it off at shipping terminal for delivery.He said they had not given him a tracking number. 4-6-09 I called shipping terminal and they stated it had not been dropped off. Contacted seller, He said he went to terminal and it was still there so he picked it up. He said he would just deliver it to me himself (2 hour drive). He e-mails 4-10-09 saying it will cost $68 to ship fed-ex because he isn't coming this way. I payed $95. on 1-28-09 for shipping. I explained to him in Jan. that this was for a birthday present for the 14th of april. I have 22 e-mails corosponding with him over the last 10 weeks. What do I do?

Based on what you say here, you could file suit against him (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to his behavior...
