Hi, i am a single individual who recently bought an electronics item second hand from another seller. As it was second hand, there was no longer any warranty. I tested it at home and it was working fine. A few hours later, i was contacted online by a fellow forumer who was interested in trading his electronic gadget for my recently purchased item. I agreed, and we met at a public location to do the trade. As we traded in public, there was no testing of the electronics. The next day, that very forumer called me up and claimed i had given him a faulty set, and wanted a refund. I felt that it was unfair to me as when i had tested it at home, it was in perfect working condition. Furthermore, he was partly to blame as he did not insist on dealing at a location where he could test the set on the spot for any defects. In addition, there would be no way to determine the exact time period which the item went faulty(e.g was it faulty before or after i had traded it to him). Also, prior to the trade i had already informed him that there would be no official warranty from the shop/company, nor did i promise him any personal refunds/exchanges. Thus i felt that it was unfair to me to refund the item to him and be stuck with a faulty set. I thus declined his offer, and declined to pay the repair fees. Somehow, he has managed to find my address and tells me he will be filing a police report against me for internet fraud. I would like to know if there are any possible actions i can take or any rights that i have that can protect myself. Your help would be greatly appreciated. Thanks. You may want to refund him or try to compromise.
It should have been working. But if it goes to small claims court, the judge will decide if you knew or should have known it was not working. It would be a bit of a judgment call. |
