Default Unsatisfactory item

What is the name of your state (only U.S. law)? SC

Here goes, I purchased an engagement ring for my wife, a few months ago. When it came in, the setting was too small for the diamond. I took it back to the store where I purchased it, and I had them pull up the website and print pictures from the (well known) company's website. The store manager agreed that the setting was incorrect (was supposed to be custom built to measurements of diamond), and proceeded to have the manufacture construct a new ring, all the while assuring me that they would make everything right. They even allowed us to keep the ring while we waited for the new one to be completed, which took a month or more because again, it had to be custom crafted to match the diamonds measurements. Well when the new setting came in and the diamond was set, the diamond was set crooked, and the setting was clearly too large for the diamond. I returned to the store and the co-manager agreed with my observations, but she wanted me to come back and talk with the other manager. I returned, and he said that we had two options, send the diamond to the manufacturer so they could fit it, or get the original setting back from the manufacturer and find a suitable smaller diamond, again saying don't worry we will make it right. I told the manager I had to ask the other half what she wanted to do, and he said that was fine. It took her a couple of days to decide, so I informed the co-manager that she wanted to get the old setting back and find a smaller diamond, she said she would call and let me know when it came in. About two weeks passed and I called back, she did not know what the hold up was, but said she would check. More time goes by, and I call the other manager on Friday who says, he will call the company and find out. He finally called the on Monday and basically said a rep now had it and that I had kept the ring more than 30 days so there is nothing he can do for me now. I am thinking I have a precedent with the first ring, and a verbal guarantee that they will "make it right". What do you guys think? Thanks.

Default Re: Unsatisfactory item

Yes your agreement with them to resolve this trumps that 30 day period. You were working to resolve this.

If you threaten to go to small claims, they will resolve this asap.
