I bought a set of 4 new tires and I was charged for tire stems that were not replaced, overcharged for 2 items I did receive, including the road hazard warranty and the shop put on the wrong tires, which were not SAFETY rated for my vehicle. When I questioned the salesman before driving away, while we looked at the tires, he confirmed they were correct (he lied). On a 300 mile trip the next day, one tire went flat, due to a bad valve stem, since they were not replaced. Repair delays caused me to miss a scheduled dinner with my boss in destination city, and had to get motel half way there. Question: Since shop only offered to replace the tires, when I write the demand letter prior to filing a small claim, can I demand treble damages for the amount of the entire transaction, since it involved intentional misrepresentation, i.e. fraud? There were actually 5 intentional 'mistakes,' so the entire transaction was affected.
I believe I can collect for motel & food in addition to the obvious discrepancies, but can I also demand, and potentially be awarded, $35/hour for all the time this has cost me? Thank you. |
