Default Contract

I signed a contract with a vacation club. However, now that I want to
reserve a condo, they say there are none available. I was told and the
contract states thea the request for a vacation condo has to be submitted
within 120 days of the time requested to use it. I put my request in over
150 days before and they are saying there is no condo available and that I
need to submit my request a year in advance. Also, they never return calls.
It took me almost a month to get anyone to check on a reservation for me.
When I call a supervisor, they don\'t return phone calls either. If I do get
to talk to a supervisor, they say they can\'t help and I need to talk with
someone else. I have not paid for this club yet except for a down payment.
Do I need to pay as I am not getting the service I was told? I want out of
the contract because I was mislead.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
