Dear Expert:
I live in Vancouver, B.C. Canada. I recently became one of the victims of a common on-line business fraud known as "Money Order Fraud". What happened is I advertise my products online and I recieved a U.S. Postal Money Order cheque worthed US $4000.00 from the buyer. The cheque was written under my name and the drawee's name was same as the company's name i had been dealing with. As too green for business, I did not have any suspection of this transaction because a money order is almost guarrentee that there is no bounce, unless the cheuqe is fake or stolen. Therefore I went to a local bank and gave the cheque to the bank teller. They advice me that because there are lots of fake cheques going, and my cheque is in U.S. currency, so the bank must hold this cheuqe for 15 days in order for my cheque to be able to cash. 15 business days later I went to the bank and the bank allow me to withdraw the money, and I expect everything is ok, therefore I sent my goods to the buyer. However, 12 business days later I check my account balance at my bank and I discover there is a negative balance at my bank, and the bank require me to cover the balance. Therefore, I dispute with the bank and ask the bank to be responsible for my lost. Then the bank says that the bank has the obligation to draw money to me and it is my responsiblity to ensure the cheque is good before I deposit it because it is written on the statement when I open the account. Please kindly advice me with your opinion. If you need further information regarding this I will be pleasure to provide you. Thank You for your time. Sincerely, Alvin Du |
