Default Partial Refund - Rights Reserved?

Due to a tour operator's error, a resident of MS and of LA each received a payment from the MS tour operator labeled "Holy Land Tour Refund" on comment line. The checks were for less than the full amount owed to payees.
If the payees cash these checks, do either cede their rights to pursue for additional amounts not included in the checks?
