I have a tax lein on my home can I refinance it? I refinanced previously to
settle and IRS debt, but it was not enough. I don't believe the house will
sell for what I currently owe. The appraisal was too high. I also have an
ARM that will go into effect in 1 1/2 years. I currently have a payment
arrangement with the IRS because of wage withholding taxes from a business I owned with my now exhusband.

If I can not refinance because of the lien, then I'd have to file a bankruptcy
(which I realize will not eliminate the taxes owed to the IRS). What
happens to the lien if I foreclose? Can the bank re-sell the house? What
can I do?

You can try to re-fi but most lenders will want that lien taken care of one way or another before they give you the money.

Meet with several lenders and they may have some options for you to help you get that resolved.
