I've decided to return to school. I plan to live off student loans. If I take a student loan and keep the funds in a bank account, will those funds be taken when I file bankruptcy, even though I plan to live off that money? Since the stipulation of my student loans is that they must be used for education purposes, including supplies and living expenses, I wondered if they could be legally touched, especially since they can't be bankrupted. I live in and plan on filing in the state of Ohio.

They can be taken but the trustee can prevent that as well and segragate the funds. i tmay be best to take funds only as you use them and do so after the bankruptcy to avoid the hassle of dealing with the bk proceeding and those funds.
