I filed bankruptcy 5 weeks ago. One creditor with a garnishment against my pay has not yet sent a release to my employer. I do not have an attorney and so have contacted the attorney for this creditor myself twice. They are aware of the bankruptcy and told me they mailed a release to my employer within a week of receiving notification. I told them my employer had not received it. They were to fax the release 7 days ago. My employer has not received it yet. I called again today and gave them the fax number again. What recourse do I have if this attorney fails again to fax the release to my employer? How do I recover the funds withheld after the date of filing?

Tell them you will report them to the trustee...and inform the trustee. That should help resolve it.
