Exclamation RENTER PROBLEMS

we have a rental property in south dakota. a family moved in dec. 19th.
they then moved out feb 29th and did not pay feb rent, used the deposit for
rent. they have now claimed bankruptcy but no papers have been filed. can
we sue them for the remainder of the rent due on the lease? also their
water bill is past due. should we take them to small claims court or send a
bill to the attorney handling their bancruptcy for the unpaid rent and water bill? thanks jodie

You can sue them unless the bankruptcy is filed; in that case all legal claims have to be made through the bankruptcy court--
