I bought a condo 4 years ago. it's a 4 unit associaltion. 2 of them are being rented. Another owner and I are having problems with the renters, but their landlords ignore our complaints. In the master deed it says the units are supposed to be owner occupied, there were no amendments. Last year we found out that the renters received section 8 program, but their lanlords never notified us about turning their units into section 8 housing. They also ignore our invitation for annual meetings, In the master deed it says any owner can call a meeting any time, they ignore this as well. Their renters are aout of control. They keep their garbage barrels in front of my windows on our driveway, their foster kids play soccer in our small back yard and violantly hit the walls of the house with the soccer ball. Is there any way to hold the owners of the rented units responsible? Thank you very much for your time and support.

I wish to inform you that the laws of your state and the purchase agreement signed between the landlords will have jurisdiction in the matter. You may serve a written notice to the other party which is in breach of agreement. If the matter is not resolved, you may file a lawsuit. The burden of proof will be on you to prove the claims and allegations made by you. You may claim damages and costs on account of breach of the agreement by the other party. The court will consider all the facts and decide the matter.

The CCR's adopted by the Homeowners Association govern a situation like this and it will be up to the Board to enforce them. My suggestion is to contact the attorney the Association retains or seek advice from a real estate attorney who represents homeowners associations.
Legal steps will need to be taken; with H.U.D. who administers Section 8 and also with the landlords who are renting in violation of the CCR's. An attorney will be able to review the CCR's and know the legal steps that need to be taken to enforce them and/or fine if that is permissible under your CCR's. |

Just another non-law person, but do you need the other owners to attend the meeting? Can you achieve quorum with just you and the other Owner/occupant? If you can reach quorum for a meeting without them, do you have mechanisms for enforcement that might be employed?
