My wife and I purchased a Condo earlier this year. Approval from the condo Association was required and obtained. The documents provided specified that leasing is not permitted without prior approval and in the absence of either owner, any occupation in excess of a period of 30 days, whether consideration is paid or not, will be considered a tenancy. Recently my two sons who are both adults occupied our unit for a short period (8 days). I received a letter from the Association indicating that unauthorized persons were living in my unit, with a threat of legal action. I have not leased the unit and my family members have not occupied for more than eight days. What are my rights in this matter? |
