A motion was recently held in an Ontario Superior Court to have a statement of claim dismissed. The motion was not granted. However the Judge granted the party bringing the motion (the Defendant) to add a third party to the proceedings. I believe that this was improper and that the third party who was not present and knew nothing of the proceedings ought to have been given an opportunity to respond to and oppose such a move. Am I right and if so can I appeal this part of the Judge's order?

The third party can come and object.
That may be the remedy firstly. Normally they would have been served papers?? |
