My car recently broke down passing through a town in Texas. There were no warning signs or detection lights what so ever, I just heard a knocking and pulled over to call for a tow truck. I have had my car for less than 2 years, it has less than 50,000 miles on the car. I was told be the service department at the dealership that there was no oil in the car, and that I couldn\'t prove that I had been maintaining it. I was able to present them with records of my most recent oil change, yet they refused to honor my warranty. On top of being treated very badly, and insulted numerous times, they told me that it would cost $6000 to fix my car. I decided to have a wrecker come and take my car from their service center to a mechanic who I trust. After looking at the engine, he informed me that he drained 4 cts of old, black oil from my vehicle. This shows that there had to have been something mechanically wrong with the engine in the first place, something that wasn\'t at any fault of mine. This also shows that the mechanic at the dealership either was too lazy to check the oil and just made an unfair assumption, or he flat out lied to me. Regardless, I was hoping that you would be able to tell me if I have a case, and what the probability of me winning would be. Or are there certain actions that I need to take that would benefit me.

If you can show oil was indeed supplied properly then based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
