I cancelled the original contract with Federated Payments only to be told that there was a different lease agreement, of which I have no copy and has a different number. I found NLS was debiting my account two times a month for other fees or extra fees for not proving I have insurance. Proof of insurance has been provided every year. I gave them monthly checks which were drawn on another account for Jan/Feb and Mar of 2012 and on April9 2012 they went into this account without my knowledge or authorization and withdrew 2 payments. The bank was contacted and told they had no authorization to withdraw money. So I have two questions
1. Do I have a case for civil action for violation of the lease? 2. Is this fraud???since they did not have any authorization to access that account? |

I wish to inform you that you may give a written notice to Northern Leasing and the bank. If they do not resolve the matter, then you may file a lawsuit. You may show to the court that money was withdrawn from your account by the leasing company in the bank without your authorization. You may show the bank statement in support of our viewpoint. The burden to prove the allegations against the leasing company and the bank will be on you. You may claim damages and costs. The court will consider all the facts and decide the matter.

There is only one effective was to deal with those crooks. CLOSE YOUR BACK ACCOUNT AND OPEN A NEW ONE.... That is exactly what we just did. While you consider any possible law suit, close your account. You can stop a particular payment or reverse a debit that was not authorized. However, they would use a different ID to remove the money or change the amount if it is fixed amount.
We signed up with Collective Point of Sales Solutions, which is the main fraudulent payment processor in Canada. What you need to do while you consider a law suit. Close you bank account and open a new one. File a report with Financial Consumer Agency of Canada File a report Canadian Anti Fraud Centre File a complaint with Better Business Bureau |
