Northern Leasing, TX -- Can they levy my bank account?

Tx - I signed a contract with Norther Leasing back in 2007 and have been harrass by this company ever since I returned their credit card machine back. They say I broke their contract and I now owe them around $726.00, but with interest and court cost; that amount is now over a $1000.00 dollars. They say they took me to count and won the case by default; by me not showing up for the case, which was in New York and I am in Tx. I am a small business owner and I could not afford to go to New York for the case. I recently receive a letter from Norther Leasing and I was inform that they will notify their attorneys to begian enforcement proceedings to Levy my bank account.

My question is: Can they levy my bank account or has anybody had their bank account levy by this company.

I wish to inform you that your agreement with the Northern Leasing company will determine your rights. You may file a motion to vacate on the ground that New York does not have any jurisdiction. Further you may claim cost. You can send the motion documents through post. You may first contact court clerk on telephone and then send the document. You may contact a New York lawyer and may have a lawyer on contingency. Further if enforcement action is taken in Texas through court then you may inform court about correct situation and can have necessary relief. In this the court can obtain stay under § 35.006(b) by showing ground that stay will be granted.

They can and will levy account!!! It was done to me I also am in Texas. I filed a motion to show cause call NYC court talk to the clerk they will help you!!! My account was unfrozen and case back in court I have an NYC lawyer handling it now... bizz8122@gmail.com more info.

Here's how this works. Under the law, to levy an account the marshall has to serve a levy on the bank where your account is "domiciled." Each branch of a bank is considered to be a separate bank. For a variety of reasons, it is posssible, legally, to levy on a New York account at any New York branch.

But an account in, say, Indiana, has to be levied on in Indiana,and they have to turn it into an Indiana judgment first.

But they levy in New York anyway. And the banks pay the levy. It's wrongful. I can fight this and because I know how to play the game, I can do it economically. Often for less than $1000.
