Thumbs Down Avis ripped me off; How can they claim reckless driving?

Hired a car in Greece in July. Had a small accident on a blind bend on narrow road. Paid for DWE. Told would have to pay excess of 900 euros. They gave us a replacement car. Took car back a week later and they said we had to pay just under 4000.00 euros as it was reckless driving and not covered by insurance. No witnesses, no police, no nothing, just the other driver. Minimal damage!

How can they claim reckless driving? Nobody saw it! The best of it was that when I signed the credit card slip for the 900.00 euros for the excess the on the day of the bump, as the woman asked me to do, she didnt fill it in but dated it a week later for the 4000,00 euros and put the transaction through and the best of it was that the credit card company didn' question the amount! I was the fool for not noticing that she hadn't filled it in as she was giving me a load of twaddle about paying for the excess and distracting me!

How do you get done for reckless driving with nobody to witness the event? I have been driving for over 40 years' no problems!

I wish to inform you that you can be held liable for the amount of loss. In this regard the loss which result from your action will be taken into consideration. If insurance has refused to pay then you may ask the other party to provide you where insurance has refused to pay and also insurance cover which was on vehicle so that you may verify the details. Further negligence cannot be attributed to you because no fault has been detected by court. You may also contest euro 4,000 claim on the ground that you were not negligent and if other party claims that you were negligent then they must present legal basis of their claim.

I know you can be held liable but who decides it was reckless driving? Nobody was there only the other driver. It was a low impact bump and the repairs would never add up to this amount. The other car had minimal damage too! The excess was 900 euros plus tax more than enough for the repair. Paid cdw but it seems the staff in the office can just say reckless driving take them for every penny. Accident report was filled in after it was signed. They told us it would be 900.00 plus tax (the excess) got me to sign credit card slip for this amount and filled the amount in and dated it a week later for the whole lot. Where is the proof it was reckless.

That's ridiculous that they would charge this as reckless driving! You should contest this excessive charge. It's seems that it was done solely to get you for a lot of money. Also, lesson to be learned - make sure everything is filled out when giving your credit card number.

Insurance claims are based on police report. So without a police report how can they say that it was a reckless driving. You are not liable to give 4000.00 euros because, if it was such a repair for that much amount it will definitely covered by insurance.
