Legal violations regarding Multiple Listing Service?
-------------------------------------------------------------------------------- Realtors are independent contractors usually working under a broker. Recently the MLS (Multiple Listing Service) which posts homes for sale went public in the state of California. These fee charges are UNIQUE to SRAR/CrisNet Any error and/or blanks are subject to.... Fines: 1st fee $100 2nd fee $200 3rd fee $400 4th fee $800 5th fee $1600 6ht fee $3200 SRAR/CrisNet provides no service to pre-check listing for errors. SRAR/CrisNet provides no service to answer listing questions. SRAR/CrisNet mail service for sending out fees to agents is backlogged due to the high volume. Almost all reporting of listing errors on the MLS is done anonymously by other realtors. In training I witnessed our instructor instruct new agents, who were upset with other real estate agents, to look up the listing and report errors. The financial damage this could potentially cause could break a business career in real estate and therefore negatively effects our business economy. There are several pages to fill out on a SRAR/CrisNet/MLS report when listing a home or land for sale. Here are examples of actual errors: * Double oven, not just oven * Freezer and refrigerator, not just a freezer * Cannot leave the Thomas Guide blank (yet it is not always in the Thomas Guide) * Exact close of Escrow Date (almost impossible to predict) * Forgot to mark the box \"sprinklers\" * Did not specify garage door opener An agent attempting to sabotage another agents business career could be quite successful simply by searching for and reporting these literally hundreds of small errors. Because the errors are reported anonymously this does not allow an honest real agent any legal recourse against the assailant This conduct is hurting small independent real estate agents. Solutions?? Class actions? Suits? Report it? |

You might ask state officials and licensing boards to look at this; the CA state attorney general may also be interested. Hard for you to sue unless you are actually damaged first.
