In response to the growing Chinese drywall problem in Florida and other states, several experts addressed the concerns of Lee County residents during a town hall meeting Sunday afternoon. The meeting, held at the Crown Plaza Hotel in Fort Myers, featured speakers Jason Robertson of Urban Habitats, U.S. Building Consultants Inc., Forensic Investigator and Consultant Spiderman Mulholland and Jonathan Gdanski of Schlesinger Law Offices. The speakers discussed health, legal and tax issues associated with homes containing Chinese drywall. “It’s essential that we stay as informed as we can,” Robertson told residents Sunday. “Some of you have been living with this for months, some of you have just discovered it in your homes. Almost every homeowner I have talked to is outraged.” So far nearly 36,000 Florida homes, some built as early as 2000 or 2001, have been effected by Chinese drywall. Mulholland, also a chairman of Defective Drywall in America, called the Chinese drywall dilemma the “biggest environmental disaster in U.S. history.”

The U.S. Consumer Product Safety Commission (CPSC) recent released the following update regarding its invesigation into the potential health hazards of Chinese drywall.

CPSC, EPA, CDC/ATSDR, HUD PRESS STATEMENT ON DRYWALL AIR SAMPLING:

The U.S. Consumer Product Safety Commission (CPSC), the U.S. Environmental Protection
Agency (EPA), the Centers for Disease Control and Prevention (CDC), the Agency for Toxic
Substances and Disease Registry (ATSDR), and the U.S. Department of Housing and Urban
Development (HUD) are working together with state partners to determine if homeowners with
Chinese drywall in their homes face potential health or safety risks. Our top priority and shared
goal is to protect the health and safety of families living in these homes. The federal government
is working as fast as good science will allow to find answers to the questions and concerns
expressed by many homeowners and to recommend possible solutions.

CPSC is leading the federal investigation and is working with other federal and state agencies to
determine exactly what substances are in the drywall, what substances are emitting odors into
the air and whether identified substances found in the air pose a safety or health hazard to
families. This is a complicated investigation and the data must be evaluated before conclusions
are made; nonetheless, the agencies and states involved share a sense of urgency in informing
the public of their findings and developing safe and effective solutions.

The federal investigation is a multi‐stage process to measure concentration levels of gases that
may be associated with emissions from Chinese drywall. First, in support of CPSC, EPA has
performed limited air sampling and monitoring in six homes in Florida and Louisiana. This effort
assisted CPSC and state agencies in developing a protocol to conduct more wide‐spread in‐home
air testing.

CPSC is testing the air in 50 homes in Florida, Louisiana, Virginia, Alabama and Mississippi. In
each state, CPSC is gathering numerous samples from homes that contain drywall produced in
China, and, for comparative purposes, from homes constructed with U.S.‐made drywall in which
no problems have been reported. Federal and state partners will evaluate the test results as
part of assessing potential health or safety risks to building occupants.

Default Lawyers: Chinese drywall makers may ignore suits

Lawyers representing homeowners and homebuilders who used drywall suspected of causing corrosion and possible health risks say they expect Chinese companies that made the wallboard to ignore hundreds of lawsuits filed against them in U.S. courts.

So, who's going to be on the hook for any damages courts might award?

That's the pivotal question for lawyers as they pursue about 300 lawsuits in U.S. District Court in New Orleans that allege a flood of defective Chinese drywall was sent into the United States after a string of hurricanes in 2004 and 2005. The material is known to decay, creating corrosive chemicals and fumes.

Among tactics lawyers are considering are suits against U.S. investment bankers who financed the Chinese companies, and seizing ships that brought the drywall to the United States.

This would not be the first time Chinese companies have ignored U.S. liability suits, said Russ Herman, a lead plaintiffs lawyer in the drywall litigation.

Kerry Miller, lead lawyer for the defendants, agreed. He represents U.S. homebuilders, drywall installers, distributors and Knauf Plasterboard Tianjin Co., the only Chinese company that's recognized the lawsuits so far. The defendants want Chinese manufacturers to respond in court because they, too, are seeking damages from the drywall makers.
