Default New Car w/ Damage

Hi,


Bought a new Honda and discovered that it had some splotches in the paint on nearly ever panel. I saw the damage in a few spots a few weeks after I bought the car and didnt think much of it; thought it could just be buffed out or something. When I took it to my detailer he found that the damage was all over and told me to take it to Honda.

I took it to a local Honda dealer and that dealer said that the dealership that sold me the car, stored the car improperly and its not a factory defect. This was with 29 days of owning the car and ~950 miles on it. An American Honda rep was there at the dealer and said they recently had a car with similar damage that was fixed with wetsanding. She tried to help and sent me to a body shop to see if the damaged could be sanded off- but the damage was too bad and it needs a full repaint to fix it.

I emailed the American Honda rep and told her about the damge and they told me to contact the selling dealership if its that bad. The selling dealership was horrible and didnt want to even see the car and were very rude. After I told this to the American Honda rep, she made some calls and the selling dealer agreed to see the car. I drive two hours to the selling dealer and basically they place the blame on me... saying the damage must have occurred while I owned it. Now American Honda rep is saying that cant take my side or the dealer's side.

They say the damage is from birds/ bees and it could happen anywhere.
Weird thing is, the damage can not be seen in direct sunglight, rather only shade. When I bough the car they showed it to me in the direct sun both times.

Looking through the new car documents, my car was a leftover model. It was actually prepared for sale in Feb 2007 and all the protective coating and wrappers that are suppose to stay on the car were removed. I bought the car in July 08. So it sat for a year and half on the lot- exposed to the elements. The dealership has no covered areas on the lot. Its all just open. I'm a 100% positive that the bird/bee crap sitting for so long in the valley heat for a year and a half is what caused all the paint damage.

What can I do from a legal point of view?
