I attempted to purchase a motorcycle after viewing an ad in a weekly circular magazine. The magazine company advertised this ad for over two weeks, the motorcycle ad turned out to be a fraud. I called the magazine company and asked about the ad after sending my money ($3000) to this false third party company set up by this criminal, to learn that they finally pulled the ad because it was not legit. Do I have a possible case against this company for small claims court? Nowhere in the magazine is there a disclaimer stating that the ads could be fraudulent, therefore, I presumed that this company would take the time and assure that each ad is legitimate. What do you think?

Normally you cannot sue them unless you can show they were involved in the scam. But you can subpoena them for information on the culprit.
