Collecting in BC for Small claims decision in MB Canada
Everything happened in Manitoba. I went to small claims. I have a certificate of decision on default and that I was granted favour. How do i collecty when the person lives in British Columbia? I believed I just had to register the Decision and then I could garnish wages ?
Do I have to fly to BC and redo the Small Claims? |

I wish to inform you that under ENFORCEMENT OF CANADIAN JUDGMENTS AND DECREES ACT you can have your judgment registered in BC and then you can have your judgment enforced in British Columbia. You may personally not be required to travel to the place. You can contact court clerk on phone and can do fax filing. In case of appearance you can request court for telephone appearance.

I will search further then. I have called the courts in BC, Canada with my Decision in my favour in MB, Canada and they told me because the person I won against lives in BC I have to start over in the Small Claims in BC or get an Enforcement from the Supreme Court in BC. Confusing.

You may file a certified or exemplified copy of your order with the BC Supreme Court so it will be recognized in B.C. Contact the court clerk, tell him or her what you have, and they will advise the form the certified copy has to be in to get it registered on the judgment rolls in B.C.

I will call BC again on Tuesday and see what I can file with the Supreme Court to collect on this decision from Manitoba. Thank you for advice. Will try the suggestions.
