I wish to inform you that the purpose of consumer protection laws is to give consumers an opportunity to remedy situations resulting from scams, misleading advertising, poor service, breach of contract, etc. A method to uphold consumer protection laws is through consumer protection class action lawsuits. Class action lawsuits are lawsuits that are brought against companies or individuals who have broken the consumer protection laws.

The Consumer Protection Act may be invoked on an individual basis or claim or if wholesale violation of the Act is found by a firm, a state attorney general may choose to file an action in behalf of the state -- or a private law firm may file in behalf of a group of similarly affected people.

In order to get a case to proceed as a class action, one must apply to the court for certification as a class. The law firm will have to allege that the injuries or claims are identical, the number of people (the class) is so numerous that allowing to proceed as a class action will resolve the issue for many people without their having to file individual suits, the major points in favor of certifying as a class action.

Class actions are not automatically approved. The court must be convinced, first, that the suit is worthy of proceeding as a class action suit.
