Default Judgment

We filed a motion to vacate a judgment and were DENIED. Citibank never did prove the charge was ours per the judge. What happen is when the judge ordered them to answer the discovery they sent us a package with all the statements in it etc. On the top was a paper for settlement saying if we sign we can avoid going to court. Of course we DIDN’T sign and wanted to keep the original court date of June 8th. Well there was another paper mixed in bottom the statements almost like there were hiding it for a judgment court date of May 10th. We missed it and showed up on June 8th only to find that we lost due to NO show. We filed the motion to vacate the judgement. When my husband filed and asked the clerk there at the time for a date she said we will be noticed. Well we weren’t and received a paper saying canceled due to no court date assigned. We then went back and got a different clerk who sort of told us we had to get the date the day we filed. It was like she wasn’t supposed to tell us. Se we got the date for Aug. 16th. We just now received notice we were DENIED the motion to vacate. Can this be appealed? What did I do wrong with the filing in Michigan.

Default Re: Judgment

You can appeal it yes; do so quickly; appeals are hard to win so don't expect miracles.
