credit card co. attorney failed to appear
I owe a credit card co. some money. Today I received in the mail a NOTICE
OF MOTION.. It goes on to say that on july 27 the credit card companies attorney will file a MOTION TO VACATE DISMISSAL AND ENTER JUDGEMENT. It says "Through inadvertance the previously set date was misdiared and that their attorney failed to appear resulting in a dismissal on june 20, 2007. It states that the Plaintiff has a meitorious cause of action. I never recieved any kind of notice for the june 20 court date. What should I do. Show up? would that constitute double jeopardy? |

Never avoid any court appearance, but call the clerk first to see what is going on.
