Default Questions about a civil restitution/promissary note

Recently I was caught up in employee theft and was made to sign a civil restitution agreement. The Loss Prevention officer said that no charges would be filed, I would not go to jail. I have two questions concerning this: Do I need to worry about police knocking on my door or a court summons even though I signed an agreement to pay restitution? If I dispute the amount of the restitution, what can be done to appeal or change it?

I would not dispute it. Be thankful they agreed--hopefully in writing--not to pursue charges.

That does not prohibit the police or prosecutor from acting, but normally they will not do so in that situation.

Thanks for the quick reply. I understand that I was cut a big break here and really all I want to do is start repaying with no further action needed. Really just looking for peace of mind to keep moving forward if that makes sense.

The link below can help as the site has experts in retail theft who can answer you. In short unless you have some sort of written agreement they can press charges. However there is no real need if you pay them back. Save all evidence of payment and when making final payment mark check paid in full

The whole conversation was recorded and he did say on tape that no charges would be brought, that I would not go to jail. Would that be enough or should I contact him and push to have something in writing? Thanks for all your time by the way. This is the first time I've been involved in anything remotely like this and I have no experience (guess that's a good thing) to draw upon.

That converation does not likely rise to the level of binding contract. I also feel you could cause yourself further problems by provoking such a contract

The conversation is probably not binding, but it may be considered a "Waiver" of sorts on thier part, yes.

If you by chance do get charged, make sure your attorney is aware of it.

Usually all they want is thier money. The purpose of a deferral of charges is to save time and expenses on thier part.

If they prosecute, the civil demand money is no more profit, but down the drain.

Just make sure you pay what is owed, IF you admit what you did. If you are innocent, plead such.

I recently had an employer agree to a full restitution agreement to keep from prosicution. 2 days later he calls back and says he is going to turn me in anyway eventhought I made full restitution. The amount I paid was actually more than the amount taken by a couple thousand dollars. But i was affraid he would press charges if I questioned it. now he is doing it anyway. Any help?
