Motion to Set Aside
Hello. I had a Judgment filed against me in small claims court. The current status of the case is Disposed by Judgment. On the case's docket it mentioned that I was served by sub-serving an individual other than myself. I don't know this person and can only assume she was the tenant who occupied the residence after I moved out. It mentions that she was a co-tenant, which she was not.
I did a bit of research on the Motion to Set Aside. I was wondering what my options were regarding this matter as I was never properly served. Can I get the judgment to be dismissed? Please advise. Last edited by gthanya : 03-30-2007 at 05:48 PM. |

Tell and write the judge that you were not served and never knew the person and he may very well set aside the judgment.

How will I know who the judge is and how can I ensure that he will get it and respond. Is this something that they will do, set aside, or do they in most cases ask you to pay it anyway?
And if he were to set aside the judgment, will it still show up on my credit report? |

contact the judge listed on the judgment--call the clerk of that judge first.
