France, one party died, now what

My friend is involved in a court case about a French garden, the person who took him to Court has just died - what happens next? Will my friend miss out on compensation?

The estate normally still have to deal with the suit and if your friend wins the estate will have to pay.

I had the same happen in Texas and we did sue the esate.
