You sure can if the knew it and purposely did not tell you, and you asked...if you never inquired it gets a bit more grey...

How are you going to prove the person knew they had it? Many times, people have sexually transmitted diseases and they don't even know it. Some are carriers; meaning they may have it, but do not display symptoms.
In our sue happy society, anyone can sue anyone for anything if they have enough money to fork over, but consider the cost vs. the outcome. It would be foolhardy, unless this was a life threatening disease, such as AIDS, to sue over this. You will have to prove the person was well aware they had a disease but did not disclose this information to you before having sex. This is usually a very difficult thing to prove. |

Well it's actually easy to prove if he knew through discovery. You can ask for his medical records, prescription drug history, witness comments, etc.
The evidence will show that he knew if he did really know. |
