WV real estate argument

My mother had owned a house 50 % interest in it but has been sole resident along with my self and my family since 1985. Her sister owns the other 50 % but has only paid taxes not upkeep , nor did she live in the house. I was moving in to the house a few months before July 09 of this year no one complained. Now my mother has passes away, and my aunt has broke in since she didn't have a key, stolen moms personal property, changed the locks and me and my family are residing there full time for the past month. I called our local cops and no surprize they won't do anything since they say she own 50 percent, Mom signed a paper and had a witness sign it stating I may have and live in house till I did. Also, I am the executor of her estate. I went to the local magistrates like the cop said to get a temporary right to solely occupy the property til it is dealt with in court and they said they can't tell me what to file. I am scared for the safety of myself and kids , since they wait until I go to work to do these acts, I* tried to speak to my aunt and she threatened me not to go back in my house.
What can i file and how much should it coust?
